Seasonal rental between individuals: what steps to take?

Rent your main residence occasionally

A main residence means accommodation that you occupy for at least 8 months per year (except in cases of force majeure, for a reason related to health or by professional obligation). You can rent your main residence to individuals for a limited period of time, 120 days a year, or 4 months. In theory, the law allows you to rent out your accommodation via an advertisement published on seasonal rental platforms such as Airbnb, Booking or Abritel. But beyond the authorized period, transactions will be automatically blocked on these same platforms. However, the case of owners who offer their property for rent on several sites is not specified in the said law. In some town halls, such as Cannes, this type of rental is subject to prior declaration. And the registration number must appear on the advertisement.

Rent your second home occasionally

Cannes is currently hosting a major renowned Festival that brings together on a single platform, different personalities from around the world. The opportunity for owners of second homes to offer their accommodation for short-term rental. If this is your case, you must make a declaration to the town hall. Authorization from the authorities may be accompanied by obligations relating mainly to the duration of the rental, the location of the property, its physical characteristics, in order not to increase the current shortage of housing in France.

The tourist tax and the tax authorities

Whether it is to rent a main residence or a secondary residence, you must invoice the tourist tax to your tenants and then pay it to the town hall. You must also declare your income, either under the “micro BIC” regime for income not exceeding 32 euros per year, or under the actual regime for income exceeding 900 euros.
