The mobility lease explained by our concierge YourHostHelper in Grenoble

Set up in 2018, the mobility lease is a short-term rental contract but the concept of which still seems rather vague when you are not sufficiently interested in it. Our AirBNB agency in Grenoble presents this contract and what it consists of.

The mobility lease is a short-term rental contract created by the ELAN law, adopted in 2018. It should facilitate access to housing for students and mobile workers, while encouraging the return to the rental market of empty housing. This, in particular in areas where the market is tight and where seasonal rental is strictly regulated, subject to a procedure with a registration number and a limit of 120 days of annual rental. The mobility lease therefore has its own characteristics.

Indeed, it is intended only for temporary occupants on professional mobility on the date of entry into force of the lease: students, trainees or employees on temporary assignment. It is established for a minimum period of one month and must last a maximum of ten months. The duration can only be modified once per amendment, as long as it does not exceed ten months in total. The tenant can terminate his contract with one month's notice. The mobility lease is neither renewable nor renewable. It is therefore impossible to conclude more than one mobility lease between an owner and a tenant for the same accommodation, under penalty of seeing it reclassified as a traditional residential lease. A mobility lease cannot include a security deposit. Only a deposit can be requested. Nor can he impose solidarity with sureties or joint tenants.

For Françoise Calabro, director of the YourHostHelper agency in Grenoble, “the mobility lease allows you to rent your property for a given period, without necessarily renting it out for the year or for seasonal rental. It's a kind of compromise, which allows the owner to enjoy his property fairly regularly, without too many constraints”. Any furnished accommodation that meets the rules of decency can be the subject of a mobility lease. For example, it is possible to rent a property with a mobility lease if you leave your home for several months, as part of a trip or professional mobility, for example.

The differences between the mobility lease and seasonal rental

Françoise Calabro, director of our concierge Grenoble, outlines the differences between the two leases. “Despite similarities, the two are different,” she says.

First of all, in terms of duration, the mobility lease lasts 1 to 10 months, while seasonal rental is limited to a maximum of 90 days for a tenant, and some municipalities even limit it to a maximum of 120 days per year. Then, concerning the tenants, the seasonal rental is open to all, while the mobility lease only concerns people in professional mobility, students or trainees.

Regarding the procedures, seasonal rental is highly regulated: many municipalities now require registration at the town hall, others require declarations of change of use, or even require authorizations before renting. The mobility lease, on the other hand, does not require any administrative declaration or request to be made at the town hall. The rent can be regulated in certain areas covered by the mobility lease, which is not the case for seasonal rentals.

Other differences, if the accommodation is not rented on AirBNB as a seasonal rental but as a mobility lease, the tenant will not have to pay tourist tax. Collected directly by AirBNB then transferred to the municipalities, it does not concern the mobility lease but only in the municipalities which require compulsory registration. In other cities, the tourist tax may be requested but the tenants can be reimbursed by making the request to the community using all the necessary supporting documents.

The mobility lease, an advantage for seasonal rentals?

Faced with the boom in seasonal rentals on the Internet, in particular via platforms such as AirBNB or Abritel, the French government has implemented numerous measures to avoid excessive expansion and above all not to disadvantage the inhabitants, who sometimes find themselves deprived of year-round accommodation as seasonal rentals abound in many cities.

The mobility lease, despite its strict conditions as seen above, can allow owners of furnished tourist accommodation to rent their apartment under more flexible conditions than a simple seasonal rental on AirBNB.

The mobility lease offers a legal alternative to renting a property all year round, without declaration, without a 120-day limit and without a change of use procedure for second homes. The rental periods being longer than in traditional seasonal rental, management and procedures are also simplified: fewer arrivals, fewer departures, less cleaning, more stability. On the other hand, the target being more restricted with very selective criteria, it can sometimes be difficult to find one or even several tenants, especially if you are not in a very large city (which is generally full of student and/or trainee profiles example).

It's possible to offer a mobility lease on AirBNB

Although it is a site dedicated to seasonal rentals, AirBNB accepts, under certain conditions, accommodation rented under a mobility lease. For this, the owner must, when creating his ad, specify in the text of the ad that he is looking for a person for a mobility lease. Reservations must therefore be for a minimum of 30 days. The process then remains the same, but the landlord will then have to have the tenant sign a mobility lease. The suite remains the same as for seasonal rental accommodation.
